Collaborate with scientific and technology teams to build strong patent portfolios around key assets to ensure a long-term competitive advantage
Lead all IP due diligence, review, and participate in agreement drafting and negotiations, including in-house drafting of certain patent applications and efficient management of outside counsel
Provide general and directed IP counsel and education to Invaio scientists and management while operationally supporting Invaio's corporate and BD efforts with regard to IP due diligence, competitive intelligence, IP in-licensing
Advise with regard to brand protection by working with stakeholders to implement trademark strategy
Ensure freedom to operate and minimize exposure to third party IP, including providing and drafting opinions
Protect patent applications and manage any/all IP disputes, engaging external counsel if needed
Supervise and direct outside counsel as needed, while mitigating Invaio's reliance on external counsel over time while building an in-house function, however, immediate needs will require engagement and execution across the full spectrum of IP work
nQualificationsn

n Required: Juris Doctorate or similar graduate degree and an advanced degree in Chemistry, Biochemistry, or related scientific field (Ph.D. strongly preferred)
Required: 10+ years of patent experience (patent preparation and prosecution, opinion work, strategic development) with 7+ years of in-house IP experience, preferably from within an R&D or Ag company
Required: Registered to practice before the U.S. Patent and Trademark Office (USTPO) or equivalent
Substantive licensing or transactional experience and litigation experience preferred
Extensive knowledge of patent law and procedure, including international and foreign patent prosecution procedure

Invaio is seeking an outstanding patent attorney to be the Head of Intellectual Property (IP) who will be able build and lead our internal IP practice within the Legal group. This person will work closely with Invaio's science and business teams to develop and grow, manage, and protect the company's intellectual property portfolio for its innovative agricultural and science-based technologies and products. The successful candidate will have a chemistry/biochemistry and/or R&D industry background preferably in agriculture and possesses deep experience in the development and protection of IP as well as FTO analysis within this industry. This person will also have a demonstrated ability to execute and manage a global patent and FTO strategy for innovative clients while being equally hands-on and able to execute at a technical/tactical level. IP Licensing/transactional experience as big plus. This is an extremely interactive role that requires excellent communication skills and the ability to provide pragmatic and business-savvy advice, identify innovations, and succinctly identify and communicate decisions to both scientific and executive teams. This position reports to the SVP of Legal.
